Resolution 102: Confirmation of hvt2011 as Vice President

! Comment from mine_man_:Jph was part of the great society congress, hvt should be allowed to as well. Party affiliations shouldn't be the reason why you deny a candidate. Instead it should be the ability to facilitate a role. This is especially backed up when 8/9 of the people who have voted against this resolution are in MRTI.

Resolution 101: The Second Electoral Reform Act

This resolution is a constitutional amendment.
This resolution abolishes the position of Election Clerk and replaces it with a new body titled the Electoral Commission. The Electoral Commission is tasked with running United Cities elections, and consists of five Electoral Commissioners, which are to be appointed by the President with the approval of at least seven non-officers, and each of which must be confirmed by the General Assembly in separate resolutions. Electoral Commissioners may or may not be members of the United Cities, however they may not be an incumbent officer at the time of the election or be a candidate in that election for any officer position. Electoral Commissioners are not considered to be officers of the United Cities.
The Electoral Commission is responsible for creating the voting form and collecting votes during the United Cities election which they are assembled for. The Electoral Commission is to internally decide on a chair, who is designated as the Chief Electoral Commissioner. The Electoral Commission is to create an online form in which players can submit their votes for the election. All Electoral Commissioners must be granted access to the responses to this form. Each voter must submit their username along with a validation code, which is to be assigned to them by the Electoral Commission. Each member of the United Cities who is eligible to vote in the election must receive a unique validation code for use in that election.
Candidate registration for any United Cities election is to begin 21 days prior to the scheduled start of the election and end 10 days prior to the scheduled start of election. If the constitution is amended to delay the start of the election after candidate registration has already opened, registration shall remain open until 10 days prior to the new scheduled start of the election.
Upon the closing of the election, the Electoral Commission is to count all votes and release the results of the election, which must include vote tallies and percentages, and which must be accurate and truthful. The newly elected officers will take office 48 hours following the release of the results, and incumbent officers will remain in office until this time. At this time, the seats of Associate Justice will immediately be vacant until new justices are confirmed or incumbent justices are reconfirmed.
This resolution repeals Amendments 13, 14, 21, and 43. Any text within the Constitution that mentions the Election Clerk shall be amended to refer to the Electoral Commission.

– Godzilltrain votes that the proposal should be rejected. I personally think this is added hassle that isn't necessary. Having an election clerk voted in by the GA, even if that required a higher approval such as 2/3 majority would seem a lot easier to me

– mjpwwf votes that the proposal should be rejected. This is a better compromise resolution, and a start; however, there are some reservations I have regarding it. Elections are a vital organ of our body, so despite my technically neutral feelings, I have no choice but to vote NAY on it until my concerns are addressed. The addition of more stringent confirmation for committee members is a pleasant sight, but I am disappointed that we still have not done anything to protect the secret ballot by not associating usernames with ballots in any form or combination of security features. To earn my YEA vote, you must do two things: (a) do not associate usernames with ballots PERIOD, and (b) once that step is finished, require access control of the spreadsheet so only the leader of the Electoral Commission has access to the results (this will help to prevent premature leaking of results before voting closes.)
! Comment from MinecraftYoshi26: To godzilltrain, SoSo123, and any one who agrees with their statements above: There is a large problem with the current system we have now. As the only former election clerk, I can tell you there are a multitude of ways that the election can be rigged. A president could send fake codes, the president and the clerk can conspire, and many more.
Now, I also have some issues with your statements above. Regardless if you like the proposal above or not, you should have legitimate reasons for voting against it. In godzilltrain's statement, it may seem easier for a higher vote, however, that still leaves the door open for a large amount of corruption and rigging. Doing a higher approval rating does not help solve any of the issues this resolution is trying to address. In SoSo123's statement, making it seem as if it is not necessary, is a falsehood. Election reform is important, as the current system we have opens doors to a lot of rigging and such. And to both points, calling this a "waste of time" is absurd. What time is wasted? Let's be honest. No time that is needed to do this resolution is a waste of other time, because the United Cities isn't doing much right now. It's not a waste of time if that time is not being used at all.
To further elaborate on this complicated issue, I have to state that a new election system can go either two ways: Able to be rigged or Public. Theoretically, it is impossible to have private voting and the impossibility of any rigging online. We can try to lessen the possibility by having a group of people like stated above. Whether or not that works, I will let you decide. However, public voting is the only way to guarantee no rigging, however, public voting discourages others from voting of their candidate is already ahead and also can create political issues. Additionally, I know that people will be upset that their votes are public for privacy reasons - which frankly, I don't understand and really don't make sense in this scenario. Having a compromise like this is the best way to have election reform for private voting, if you want to go down that route.

Resolution 103: the Arbitration Resolution Exemption Act

This resolution is a constitutional amendment.
Upon passage of this resolution, Arbitration Resolutions will be exempt from Amendment 41. Arbitration Resolutions must specify in the first paragraph a set of conditions of voting to specify which side of the arbitration resolution a member agrees with (For example, If in favor of option 1, vote "Option 1", if in favor of Option 2, vote "Option 2"). These conditional phrases are to be the only way an Arbitration Resolution is voted upon.

Upon passage of this resolution, if a resolution goes to a tiebreaker when the office of vice president is vacant or the occupant fails to break the tie within 24 hours, the next non-vacant office from this list will have the tiebreaker vote for 24 hours, whereby if it still doesn't get voted upon, it will pass to the next officer: Secretary of State, Chief Justice, Attorney General. If all of these are vacant or fail to vote within their allocated 24 hour period, then the resolution passes immediately to the President.

Upon passage of this resolution, "Money Money Money" by ABBA will be the official anthem of the United Cities. At the beginning and end of every United Cities sponsored event that has a presence in either a discord voice channel or mumble, this anthem must be played.

Resolution 108: The John Smith Act

A Competition will be launched to find or create an anthem, the winner of which becoming the official anthem for the United Cities. The UC Discord Channel #Competitions will be used for any member of the United Cities to submit entries. Upon the passing of this resolution the competition shall begin, and any potential competitors will have exactly two weeks to submit their anthem. People may submit only one anthem, and it must be accompanied with the text 'ANTHEM'. That is to differentiate the entries from any other competitions in that channel. Once the two weeks are up, the President will create a voting form for all submitted competition entries. Members of the UC will then be able to rank each entry out of one to ten in this form. This voting process will last 1 week. Once this week is up, the top two entries with the highest score in this form will then be entered into a new form, where UC members will be able to decide amongst the two in the form as to which one they prefer. This process will last 1 week. The winner of the second form will henceforth from that moment become the official anthem of the United Cities.

This resolution is a constitutional amendment.
The July 2017 election, and any other election where there is not a full Electoral Commission by the start of the election, shall be delayed until 24 hours after a full Electoral Commission is confirmed.
If a full Electoral Commission is not confirmed within 72 hours of the scheduled start time of an election, anyone in the General Assembly shall be allowed to nominate any person for the Electoral Commission as long as the nomination has three non-officer endorsements. Nominations from the general public shall be confirmed by a normal General Assembly vote as are those from the President, however the President shall not be required to sign a nomination resolution in order for the nominee to be confirmed.

This changes the start time that is stated in amendment 54 to 48 hours after a full Electoral Commission is confirmed. Starting with the October 2017 election, if an election is delayed due to a full Electoral Commission not being confirmed, the election shall be delayed 48 hours until after a full electoral commission is confirmed.

This resolution clarifies that any vote cast in a United Cities election must be cast by a player who is eligible to vote at the time they cast their ballot, and the player must remain an eligible voter for the entire remainder of the election, otherwise the vote shall be null and void. This resolution applies to all elections from the July 2017 election onward, unless it is enacted following the conclusion of the July 2017 election, in which case it shall only apply to all future elections.

Resolution 126: The UC Headquarters Maintenance Act

This resolution creates a legislative committee to create regional UC Offices, while maintaining and, if necessary, expanding the current UC Headquarters in Central City. The chair of the committee shall be _Kastle, and the chair of the committee shall have the right to appoint or remove additional members of the committee as he or she sees fit.

We have already established that people don't need a committee to build UC regional headquarters that are essentially franchises that people can build themselves. VernCow proposed a very similar resolution before and I feel (don't know for sure) that many of the same people who had qualms about that one are voting for this one. This isn't the only reason for the change, but is it because of the person who proposed this newer resolution?.

Resolution 127: Parks and Recreation Transfer Act

This resolution is an enacted resolution.
Upon approval of this resolution, the Parks and Recreation Committee shall be converted from an executive committee to a legislative committee.
The committee once transferred will be chaired by the current chairman mine_man_, and shall keep the current members. The chairman will be able to nominate and appoint members to the committee or revoke membership with a majority vote inside of the committee.
The chairman of the committee can be replaced with a 60% vote in favour of another candidate by members of the committee. This candidate must be a member of the committee prior to being chosen as chairman.
The goal of the committee will remain the same.

By the power vested in me as Chief Justice of the United Cities Court, I, mjpwwf, present to the General Assembly dragonbloon419 as one of my two nominees for Associate Justice of the Court forementioned.
This resolution shall be treated as a motion of the General Assembly.
ADDENDUM: In accordance with the Resolution Amendment Bill (Amendment 42,) I am required to disclose the changes that have been made to this resolution, which have been marked in bold. There are no cosponsors to this resolution, and therefore I invoke my Amendment 3 authority to put forth nomination resolutions as Chief Justice of the United Cities with regard to Amendment 42, clauses 1 and 2. In compliance with clause 3, the vote count has been reset accordingly and voting deadline has been changed as if this resolution were just posted.

I, using the powers given to me as Vice President, veto this resolution.
My reasoning for this veto is because of the polarized vote on dragonbloon and how a polarized candidate for a role which oversees and facilitates the court alongside the chief justice is better to be approved with a large majority of support.
I do not want to use this power to obstruct justice or the democratic process or to turn the UC into an elitist organisation.
I recommend mjpwwf to choose another justice with help of the current officers and general assembely working together to get someone everybody wants. - mine_man_

Resolution 131: Nomination of ryanfr for Associate Justice

WHEREAS this Chief Justice has not had the most successful time choosing Associate Justices, and so apologizes to the United Cities for the delay in said process;
WHEREAS the people of the United Cities, including yours truly, demand qualified candidates for such lofty and honorable positions as those in the judicial branch of the Court;
WHEREAS ryanfr is experienced within the United Cities, having served on various committees including the Electoral Commission, and in so doing has sufficient knowledge of its laws;
and WHEREAS ryanfr has not served as an elected official of the United Cities in the past;
I THEREFORE NOMINATE ryanfr to serve as Associate Justice of the United Cities Court.

Resolution 130: The Timely Nomination Bill

This is a constitutional amendment.
This applies separately for each Associate Justice position.
Should an Associate Justice position become vacant for whatever reason, the Chief Justice shall have a 14 day countdown, starting from the moment the vacancy is created, to pick a nominee to fill such vacancy. When a nominee has been chosen, that countdown will be stopped. If the nomination fails to pass the General Assembly, then the Chief Justice will get 5 days to pick a replacement nominee. Every time a nominee fails a General Assembly vote from that point on during the vacancy in question, then the Chief Justice will always get an extra 5 days to pick a replacement. The 5 days is only for an ongoing vacancy; any new vacancy will get 14 days to start.
If the Chief Justice has failed to nominate an Associate Justice by the time the countdown is up, then the right to pick an Associate Justice for that vacancy will be stripped from the Chief Justice. Instead the power to nominate will be handed to the President, who will need at least one extra endorsement from any other officer (Can even be the Chief Justice), before putting a nominee up to the General Assembly. If that nomination fails then the President must choose again.

It is with sadness and disappointment that I put forward the first impeachment resolution in the history of the United Cities. Even now I feel bad that I am proposing this, but I feel that it's a necessary evil.
I am proposing this because Chief Justice mjpwwf has failed to execute his duties as Chief Justice in a timely manner. Firstly, he did not get a single Associate Justice confirmed until August the 23rd, almost a month after he took office on July 26th. Yes, he was forced to withdraw SilverBubble and dragonbloon419 was rejected by the General Assembly, but that was no real excuse for him to have waited a full two weeks to nominate an Associate Justice for the first time, and then after his second nomination is rejected via a close vote in the GA, wait another one and a half weeks to nominate ryanfr. And there is still a vacant seat on the Court. Keep in mind, that we have spent nearly a third of Chief Justice Pueff's term without a single AJ, and nearly, if not over, a third of the term and counting without a full court. If that is not enought, there should also be the fact that Chief Justice Pueff has also procrastinated severely on Court Case #10. Case #10 was submitted on August 9, and at the time of this writing, it has been nearly three weeks that the case has languished without a decision, and it has been over a week since August 19, when Chief Justice Pueff said he was in the process of writing the decision. Regardless of what outside factors there are, there is no reason that a Court Case should last for three weeks, nor should a third of the term be spent without a full court.
I would like to stress that this resolution is not because I dislike Chief Justice's Pueff's ideology, his personality, or anything about the content of the decisions he has made. It is that he has failed to execute his duties in a timely manner, which is a disservice to the Court, to the parties of Case #10, and to the United Cities as a whole.
To mjpwwf: I do not hate you, and I am not doing this because I hate you. However, you have taken no real action so far to address your inactivity, even though you have came on both the MC server and Discord. I am willing to change my mind if you explain yourself and provide a method of your own to rectify this issue, such as marking yourself inactive or resigning. Otherwise, the United Cities really has no choice but to remove you from office and replace you with someone who will be active.

To the members and officers of the United Cities:
I am not writing this for my benefit, or as a favor to anyone else. An explanation is warranted, and I will do that the best I can without getting fuzzy. Don't take it as anything more than that.
I have failed. I have failed you. I have failed the United Cities, and I have failed the MRT Server by my actions (or lack thereof.) It's my fault, and I'm not going to whine about what's going on like your typical politician. Though it is on me for breaking my campaign promises which I was so passionate about not breaking. I've become a politician, and I can't stand myself now.
Earlier this summer, I assumed the role of Associate Justice for various reasons. Normally, I would desire no place in power, because, let's face it, you never think of yourself as always "fully prepared" for the role. Power in a lofty office, like Chief Justice, must be assumed by someone committed to the organization, which I was at the time. Then, plans changed. I had just been through the orientation festivities at my college. I knew this would change my ability to stay active, but I was too passionate about the United Cities and its most important watchdog, the Court, to see (a) it be corrupted by politics and ideology, and (b) its leadership continually rotate among the same people. So I took a breath, and accepted the position. It was the same when I ran for Chief Justice. I didn't plan on it, but at the time I thought the list of candidates that year didn't give my coalition a good chance. I loved my Court too much to see it lose its impartiality, and I despised the thought of breaking any campaign promises to do it. If I could do it, so could anyone, right?
Wrong. Other things took a hold of me, and I couldn't prioritize or let go. Simply put, I'm trying to micro-manage too many things at once. Some are in my personal life, the biggest of which are college (which, ironically, I finished moving in to today,) and the additional hours I'm taking at my work. Others are on this server, like the many plans I have made for Danielston that I still have failed to complete. Oh, and I'm still angry that my former deputy mayor, one of the best friends I had on this server, lied to me and my colleagues. But that's for another day.
In short, I take seriously things that don't need to be, and vice versa. It's taking a toll on my health, and clearly, my reputation. I'm about as stoic a person as one could get. I believe personal emotions or apologetic dancing around the truth have no place in Court operations. Nevertheless, I have put my emotions first, and thus have become the worst kind of person: a hypocrite. Clearly others understand this as well.
I resign immediately from my post as Chief Justice of the United Cities, and not only this, but I will also take a hiatus from the United Cities altogether to focus more on the real world things I clearly have been prioritizing over my duties.
I recommend Jian_Zen (formerly tomtomy8) to serve as an Associate Justice. Though he and I disagree from time to time, he's professional and ready for the job. Matter of fact, I was just about to nominate him before I saw this.
Finally, I leave with one piece of advice to you all, which many of you already heed, but which I nevertheless want you to reflect on. Politics is something interesting to discuss and work with. But you really only understand it once you gain enough experience and the issues start to get in your own way. The only way to make things work is to draw from what you have experienced, not parrot talking points, investigate both sides, and allow people to draw their own conclusions. That is the mark of democracy.

The powers of such office shall be given to another person who shall be entitled "Acting [Officer]." in Amendment 20 to state "If any officer fails to join the MRT Server and fails to vote on a United Cities resolution for 15 days, they shall be marked inactive and have their powers stripped. The powers of such office shall be given to another person who shall be entitled “Acting [Officer]."
This resolution clarifies that both need to be satisfied to be marked inactive. This is being changed by the court, and some members, do not simply understand the word "or" and simple English rules about the word "not" with conjunctions. By wording it in this way, it makes the intent of the amendment clear and corrects the previously poorly written sentence.

Resolution 145: The Electoral Loophole Elimination Act

Should they fail to do so the court must subpoena the results. Failure to comply with the Court's subpoena within 24 hours will result in the members of the Commission being dismissed from the Commission, an entirely new Commission being chosen, and the election being restarted with the same candidates. This also applies to the October 2017 election.

Currently, events sponsored by the UC and resolution timers are put in different time zones, creating unneeded work for members to convert the time said to theirs, especially thinking that there are :45, :15 and :30 timezones, which might create inconvenience for some members. Upon passing, all time for events and announcements needs to have UTC time and if a time does not have UTC, a note for the UTC time is needed. For example, if an officer is doing an announcement about a coming town hall event, he may put the time of his timezone if he wishes but he must put the same time in UTC timezone.

Resolution 150: The Supremacy & Enforcement Act

This resolution is a constitutional amendment.
This resolution declares that the United Cities, its Constitution, and all its policies and procedures exist within the bounds of the rules of the MRT server, and may not contradict the rules of the MRT. Any member of the United Cities is bound by MRT rules while acting in the capacity of the United Cities.
If a portion of the Constitution or any law, policy, or procedure is believed to be contrary to the MRT rules, a suit must be filed with the United Cities Court, which is to determine whether the law contradicts the MRT rules. In order for the Court to issue such a judgement, the testimony of at least two staff members is required. However, the Court may be overruled by a declaration of the Owner or an Administrator of the MRT server, either before, during, or after a case held before the United Cities Court, and the Court, and the rest of the United Cities, shall be bound by such judgement.
A new Officer position, titled the Secretary of Enforcement, shall be created, which shall lead the United Cities Department of Enforcement, a cabinet level department as defined by Amendment 30. Should a member of the United Cities be believed to have violated MRT rules or United Cities law while acting in the capacity of the United Cities, the Secretary of Enforcement shall have the power to issue an Enforcement Citation, after three of which obtained by one member that are simultaneously effective the Department of Enforcement may issue an order to remove the member in question from the United Cities or demote them to the Observer rank, which shall not last for more than thirty days. The removal shall take effect within 24 hours of the issuance of the order, which is subject to appeal to the United Cities Court. The Department of Enforcement retains the power to revoke an Enforcement Citation or removal order, including one issued under a previous administration. Enforcement Citations are to remain effective for thirty days from the date of their issue, and may be appealed to the United Cities Court.
The Secretary of Enforcement may issue Enforcement Citations to any Officer of the United Cities, however a removal order may not be immediately issued upon an Officer receiving three Enforcement Citations. Rather, upon an Officer receiving three active Enforcement Citations, the Officer must be removed from his or her official position, through impeachment, resignation, or other legal means, before a removal order may be issued.
The Secretary of Enforcement, as opposed to most other Officer positions, is to be appointed by the President of the United Cities, beginning with the President elected in the October 2017 election, and confirmed by a majority vote of the General Assembly, to a term that shall expire upon the assumption of office of the Officers elected at the following election. The Secretary of Enforcement shall be subject to the same term limits applied to Officers as stated by other portions of the Constitution, and shall have the power to delegate their powers among staff members of the Department of Enforcement appointed by the Secretary of Enforcement.

While I support this resolution, I believe that this resolution should be improved further, which I will propose to the General Assembly should Resolution 150 be passed.
My main concern about this resolution is the exclusion of the General Assembly. Under this resolution, a member can only be removed by having 3 strikes from the Secretary of Enforcement. I believe that a legislative procedure should be instigated if a member of the General Assembly disagrees with either the Court's decision or the Department of Enforcement. I believe the procedure should be as follows:
If a member of the General Assembly disagrees with the imminent suspension of a fellow member, they may propose a constitutional amendment in order to reinstate the removed member - however as the removal of a member is generally a serious action, the proposing member must have 5 General Assembly endorsements (Observers excluded). The resolution is put to the General Assembly per Amendment 7. Should the resolution pass, it overrides the decision of the Secretary of Enforcement/the Court and the member is reinstated.
These are only my ideas. They are, of course, open to debate underneath my comments.
If this resolution ever gets to the General Assembly, I should stress that any resolutions must be a constitutional amendment in order to fulfill Section 9 of Amendment 27.
– SoSo123 votes that the proposal should be rejected. Having a specific person to handle this is not that fair to me. Should have a random mix of people including observers instead should be better, with a maxinum of 1 officer in the group to handle it each case is scheduled. The complaint should be put in public chat and then a small group of random people will be formed to handle it, which should have at least 1 staff member. Just a thought.
