Resolution 51: Nomination of Jphgolf4321 as Associate Justice B

The question of whether Jphgolf4321 will or will not become an Associate Justice of the United Cities shall be voted on in this Resolution.

Resolution 50: Equality Act

Proposed by hnt, endorsed by camelfantasy, AP_Red, and FredTheTimeLord

This resolution fully repeals Amendment 4, removing an Officers' right to propose a resolution without gathering endorsements, due to the fact they were given that power to make up for losing their ability to vote, which has since been restored. If this resolution is passed, amendment 4 will be replaced with a new amendment stating that only the President cannot vote in the General Assembly, and that only the President has the ability to propose resolutions without gathering endorsements, in addition, it grants the Vice President the tiebreaker vote in the event of a tie in the General Assembly.

Resolution dies.


Fellow United Cities members and officials,

Naturally, as leaders, officials wish to incorporate their platform and follow through on their campaign promises. We see this in our newly elected officials, who are ready to get things done. There is nothing wrong with a strong executive branch, but if we keep legislative fast tracks for officials and leave weak statutes to check these officials, we could be writing a suicide note for our MPO. Cause of death: vast abuse of executive power, similar to what happened in the LoC.

By definition, democratic republics exist based on consent of the governed. We joined this MPO by consenting to it. A fatal mistake committed by many political officials is neglecting the accountability element which comes with a consensual democratic system. Officials - in this case, a group of four - must keep the consent of the governed by carrying out the desires of the people. Many of us have a jurisprudence which cites international treaties and statutes of nations other than their own. I do not usually have such jurisprudence, but I will use it in this case and appeal to the American Declaration of Independence. This fundamental document spoke of the right of the people to "throw off" a group of officials who do not carry out the desires of the people, whether with their vote or, in extreme cases involving violations of the Constitution, by impeachment.

By and large, we grappled with the issue of consent of the governed on Christmas Day, where in a tough fight we passed the Restoration of Democracy Act and abolished the Security Council. The prime argument was that it, as a group of six Governor's, did not act in the best interest of those with lower ranks. We the people voted to lower the influence of a group of six on an MPO of about thirty. Now, we the people pass an amendment to equalize power balance between government and governed - which involves a group smaller than the Security Council - then it gets vetoed, and suddenly everyone rallies behind the veto-ers. This is more or less a paradox, and while I may never understand this ideological flip-flop, I do know we are making a huge mistake by doing so.

Many serverwide MPOs which came before this one failed because their democratic element was compromised. Let us not let that happen this time, and override resolution 50's veto. And, whatever happens, ALWAYS remember that you, the people, are the champions of tomorrow's democracy. Don't ever let a group of four, a group of six, or a group of any size take that away from you. Stand up for yourself, assert your rights as an equal member of the MRT, and vote to keep our few leaders accountable to the many, more important lead-ed.

I would like to point out that, in my opinion, calling this privilege "fast tracking" is a blatant misrepresentation of the power. It suggests that officers have the ability to shorten voting time or otherwise rush the process of voting to their favor, which is not what this is. It just allows officers to introduce their policies more easily. Also, impeachments exist, and if someone abuses this power I will be the first to endorse an impeachment. I feel like, though well-written, Mr. Peuff's letter is a massive overreaction. The United Cities will not fail because of the failure of this Resolution. The so-called "fast-track" clause is actually checked all the time. Though officers have the ability to propose legislation without endorsements, they take the risk of it falling flat on its face because of the lack of any debate on the matter. Mineman's Resolution from earlier stands as a perfect example of this: mineman proposed the Resolution without any prior debate, people didn't like it, and he had to reset it with major changes multiple times before the vote actually began. People forget that, while officers have an easier time with the process of proposing a Resolution, the will of the people is what decides if it succeeds or fails no matter who proposes the legislation or by what means they propose it. jphgolf4321 (talk) 14:12, 25 January 2017 (UTC)

Earlier debate during 1st GA vote cycle

Amendment 4 allows narnia17 to have a tiebreaker vote. Removing the entire thing removes the tiebreaker. Then what? Also, having a perk for SoS gives the rank a) a purpose and b) an easy way to get resolutions quickly to the GA if needed be. You also can't just create a new amendment replacing Amendment 4, you would have to have a resolution passed. I would recommend you passing a resolution to evoke just the single clause giving SoS the passage of resolutions. I see how you have complaints but this resolution should be thought through better. - mine_man_ Mr. Secretary - as stated above, hnt will propose a new resolution which will continue to bar the President from voting with the General Assembly. While I cannot speak for him, there is a certain chance he will incorporate the VP-tiebreaker clause into the new resolution to maintain the abilities of Narnia's office. Should this not be the case, I will propose a resolution reinstating the same.

Also, the ability of officers to introduce resolutions without cosponsors is viewed by several members as a major power-balance issue which could allow for too much centralized control at the top. Such a perk may allow you to get things done which you wish to get done, but the imbalance of power at the top also goes against your party platform. As Secretary of State, your constitutional responsibility is to mediate, arbitrate, and negotiate when necessary. Such a role is executive, not legislative, and free of prerogative.

I see the current state of affairs happening either of two ways: either this resolution passes and officers lose their "fast track," or this resolution dies and a new one is proposed which would allow GA members to have the same perk as you. No matter what you decide, the people will want a strong, expedient process to put resolutions to forum, and they will remove any sign of power imbalance with their vote. In the meantime, I vote yea on this resolution, and would be happy to cosponsor the resolution replacing Amendment 4. Pueffie (talk) 21:40, 23 January 2017 (UTC)

I'd like to note that if this resolution passes, the amendment mentioned in the resolution will be added if this resolution passes. As much as i realize it does go against part of my parties platform, it also goes for my progress and project platform. The only use for it i have seen so far is being able to make jph not be an election clerk because he has seen the codes, and that was proposed by me. To me that sounds like supporting fair voting and equality. Removing the right for officers to pass resolutions quickly just allows the process to be sped up, and if you dislike the proposal they are trying to speed up, you can just vote NAY on it. It isn't centralizing power, all it is doing is just speeding up how urgent constitutional amendments are made. - mine_man_
After reading the constitution again i have realized that the arbitration point i have made is already covered by the old constitution. Therefore i am changing my vote. - mine_man_

Resolution 52: The Constitutional Clean-Up Act

Upon the passage of this resolution, current and future passed resolutions would be sorted between formal amendments and a separate page with other ones. Resolutions that pass that alter the constitution would be considered amendments and would go on the constitution page, while other resolutions concerning other topics (such as creating a Discord, planning the AX0, or The Friendship Act) would go on another page, called enacted resolutions. In the future, when a resolution altering the constitution is proposed, it will be labeled as an “Amendment”.

Resolution 53: Official Accountability Act

Proposed by mine_man_ with constitutional exemption, written by kiwirainbow

With the enactment of this resolution, the following changes would occur, while maintaining the validity of Enacted Resolution 8:

5 committees of 10 members each (and 1 committee of the 1 remaining member and all future members) will be formed by the President. All members (who are not elected officials) of the United Cities will be permitted to have a spot on only one committee. A form will be released for members to express their interest in being on a committee. Once formed, these committees will each elect their own chairman to lead the committee. The committees will have their own, official power, and will be permitted to bypass the general assembly in passing resolutions. This can occur by any committee member introducing a piece of legislation and a majority of the committee voting and approving. A committee must pass only legislation that fulfills their intended responsibilities. In addition, committee resolutions can be repealed like any other general assembly resolution. The goal of these committees are to keep the officials in check and maintain a strong community in the United Cities, where as many members as possible can be active. This will build trust in the system and ensure a fair, responsible United Cities. Committee assignments will change every other election. Below are the committees and their responsibilities.

  • The United Cities Committee on the Judiciary- Keep the powerful and officials accountable by holding trials (with 50% General Assembly approval) to ensure all officials (including the Chief Justice) are obeying the United Cities constitution. (10 members total)
  • The United Cities Committee on Business and Commerce- Find incentives to promote business within the United Cities and encourage growth. (10 members total)
  • The United Cities Committee on Server Relations- Further the well standing between the United Cities and server staff, MPOs, and other inter-city organizations. (10 members total)
  • The United Cities Committee on Infrastructure- Promote and assist in the construction and development of new modes of transportation, including road, rail, air, and boat as a way to link member cities. (10 members total)
  • The United Cities Committee on Elections- Ensure the fairness of elections and organize debates for elected officials. (10 members total)
  • The United Cities Committee on City Relations- Advance the well being among cities and advance the inclusion of new members. (1 member and all new members upon the passing of this resolution)

Resolution 54: The Resolutions Act

Proposed by KittyCat11231 with constitutional exemption.

This resolution is a constitutional amendment.

This resolution repeals the clause in Amendment 1 that officers may propose resolutions to the General Assembly without gathering three endorsements beforehand, and upon the passage of this resolution, no member of the United Cities, with the exception of the President, will be able to propose resolutions to the General Assembly without the endorsement of three other members of the United Cities, unless given a special exemption by the President.

Resolution 55: The Resolution Compromise

Proposed by jphgolf4321 with constitutional exemption.
This Resolution would amend the Constitution.
As an alternative to Resolution 54, Resolution 55 seeks a compromise between stripping officers of their resolution proposal power and keeping them as all-powerful as they currently are.
Should Resolution 54 pass, this Resolution would nullify it and replace it. Upon its passage, this Resolution will require officers except the President to seek out one non-officer endorsement in order to propose a resolution. In addition, non-officer players may not approach an officer with a draft of a Resolution to ask that they propose it in an effort to avoid seeking endorsements as was done in the case of Resolution 53.

Vetoed; This resolution does not solve the problem as it still allows officers to push resolutions with little oversight. Additionally, the section of this resolution stating, "non-officer players may not approach an officer with a draft of a Resolution to ask that they propose it in an effort to avoid seeking endorsements as was done in the case of Resolution 53," is practically unenforceable as an officer could simply choose to not mention that they were not the author of the resolution. I will admit that I have changed my mind on this issue. Resolution 57: EMERGENCY AMENDMENT TO ARTICLE 3

This resolution is a Constitutional Amendment Proposed by _Kastle with an emergency exemption granted by _Kastle _Kastle (talk) 15:13, 31 January 2017 (UTC)

This resolution immediately repeals the section of Article 3 which states that elections will begin in February, since they officially occurred in January. The current text stating that elections began in January will remain.

NOTE: This resolution is necessary because of the Constitutional Clean-Up Act, which made the January Election Act an enacted resolution, made it subservient to Article 3. If this issue is left open, according to the constitution, the first elections would be held in February. This is a clear contradiction since the first elections already occurred.

Resolution 58: The Department of State Act

This resolution is a constitutional amendment.

This resolution establishes the procedures of the Department of State.

The Department of State is responsible for providing a means of conflict resolution between two parties. The Secretary of State, who may appoint additional staff to carry out some of his or her duties, presides over the department. The Department of State may maintain its own wiki page and Discord channel, as seen fit by the Secretary of State.

Two or more players who are involved in a dispute may choose to file a request with the Department of State to review their dispute. The Secretary of State has the discretionary power to deny requests for arbitration, and a request can only be accepted if all players involved agree to resolve the dispute with the Department of State. If a request is accepted, the Secretary of State may meet with the involved players and attempt to resolve the dispute. The Secretary of State will negotiate with the involved players and attempt to reach a resolution to the conflict. If all players involved agree to the terms of the resolution, of which there must be documented written proof, the terms of the resolution will be binding and enforceable by the United Cities.

The players involved may also agree to an arbitration resolution, as specified in Article 4.1, to be put before the General Assembly. All players involved must agree to the arbitration resolution beforehand for it to be valid, as properly documented. The arbitration resolution will allow the General Assembly to vote on a set of pre-determined resolutions to the conflict, and is not subject to Presidential approval. Upon the passage of the resolution, its result will be legally binding and enforceable by the United Cities.

To clarify, the Department of State is strictly responsible for the resolution of extra-legal conflicts, which do not include disputes related to United Cities law. Any dispute regarding United Cities law is under the jurisdiction of the United Cities Court. However, should a resolution to any dispute filed with the Department of State become legally binding, as specified in the above paragraphs, the United Cities Court will have the power to enforce it as law.

Resolution 60: Committee Amendment Act Amendment Act

This resolution is a follow-up to Resolution 59. Should Resolution 59 pass, this resolution states that, should the President disband an executive committee which is currently in the process of undertaking any project authorized by the United Cities, a temporary committee will be established automatically to facilitate the completion of the project, consisting of the members delegated to the project. The committee cannot be disbanded by the President, however it can be disbanded through resolution. Should Resolution 59 not pass, this resolution shall remain inoperative.

Resolution 61: Judicial Adjustment Act

This resolution is a constitutional amendment.

This resolution modifies the procedures of the United Cities Court to ensure its efficient operation, and refines and clarifies some of its procedures. This resolution amends provisions of Amendment 3 and Amendment 11.

As specified in Amendment 11, any complaint filed with the United Cities Court must be responded to within 48 hours. The appropriate responses are detailed below.

Any justice of the United Cities Court may, in response to a complaint, schedule a hearing to resolve the complaint, which will be presided over by such justice. This hearing must be scheduled within 24 hours of the response to the complaint. However, if the case is requested to be reviewed en banc, all justices must agree to a hearing date within the original timeframe (see below for more information). The justice will hear arguments from any and all sides involved in the complaint. If any party involved in a dispute is not present, the hearing will not proceed, and the justice may reschedule, however if the party fails to appear within a week of the original hearing date or after three scheduled hearings, whichever comes last, the case will be continued as follows: if the party absent is responsible for filing the complaint, the case will be dropped; if the party absent is targeted in the complaint, the case will continue under their absence. The justice presiding over the case must ensure a fair courtroom and all parties must be ensured equal protection under United Cities law, and, upon conclusion of the hearing or hearings, may render a legally binding decision. When such a decision is made by an individual justice, their decision must align with precedent set by the court.

Cases may also be decided en banc, with all justices of the court present. This occurs under the following conditions: any party involved in the case requests the case be reviewed en banc following the issuance of the complaint; any party involved in the case files an appeal against a decision made in a case presided over by a single justice; any justice requests the case be reviewed en banc following the issuance of the complaint, or; any justice files for review of a decision made in a case presided over by a single justice. If the court decides to review the case en banc following the issuance of a complaint, all justices have within the initial 48 hour timeframe to agree on a date for a hearing. If a decision by a single justice is to be appealed to the entire court, by either the request of one of the parties involved or any justice, the justices have within 48 hours of the request being filed to schedule a hearing date. The procedures and rules for the hearing will be the same as stated above. Any decision, requiring the majority vote of the justices, is final.

With regards to the initial complaint process, the justices may also decide to not review the case. This requires the approval of all justices within the 48 hour timeframe specified following the complaint. If at least one justice requests the case to be heard, one of the other responses specified to the complaint must be made before the end of the 48 hour time window.

In the event the complaint is not responded to within 48 hours, the following response must be made. If the case cannot continue due to the absence of a justice when the case is to be heard en banc, the respondent justices must sign a declaration stating the failure to proceed. The case may then continue with the Chief Justice and one Associate Justice present, however if both Associate Justices are absent, the Chief Justice will preside alongside two interim Associate Justices appointed by the Chief Justice and agreed to by the parties involved in the case. If the case cannot continue due to the absence of the Chief Justice, the Secretary of State will be the Acting Chief Justice, with the line of succession including the Vice President and President, however they shall only be in charge of the administration of the court and will only receive a vote if necessary to break a tie.

To clarify the powers of the court, as not explicitly stated in Amendments 3 and 11, the court can only issue a full decision with binding legal force if a proper hearing is held as described in this resolution. The court may not issue binding decisions without a hearing. Should a complaint with the court be declined for further review, the court may detail its reasons for declining to hear the case, however no text of this reasoning is considered a binding legal decision by the court. This provision applies retroactively.

This resolution, in conclusion, serves to create a better United Cities Court, that can more efficiently resolve issues and has more clearly enumerated powers and responsibilities.

Resolution 63: The Committee Efficiency Act

This is an enacted resolution. Proposed by _Kastle, exempt from endorsements _Kastle (talk) 07:37, 16 March 2017 (UTC)

This Resolution repeals the section of Enacted Resolution 8 that states, "Executive committees are not allowed to undertake any projects without the approval of the General Assembly; for the purposes of clarity, approval shall be conducted through a normal resolution with the President approving or vetoing with the GA retaining the ability to override vetoes," and replaces the deleted text with "Executive committees are allowed to undertake projects without General Assembly approval that have net expenditures of $0. Any project proposed by an executive committee that has an expenditure of greater than $0 must be approved by the General Assembly via resolution. The president may, at his or her leisure, choose to pay the expenditures of a given project out of his or her own account balance. If the President elects to pay the full balance of a given project proposed by an executive committee, the project may proceed without General Assembly approval."

Author's Note: The purpose of this Resolution is to allow executive committees to have the necessary independence to complete projects in a timely and efficient manner, while still protecting the members of the UC from the financial burden that could arise if an executive committee attempted to undertake an expensive project without proper authorization.

A Note from Pueffie
Don't get me wrong, I understand the point of this resolution, and I agree with its goals. If we choose to establish a committee, it should be operating at maximum efficiency no matter what; otherwise, it's just unnecessary and bureaucratic. However, such a plan as this will, I believe, not achieve those goals, for the following reasons.

  • Allowing "free" jobs to go through without the approval of the people will remove economic incentives away from paid jobs, and risk overworking committed members of UC committees at your expense. Small-scale projects like diamond interchanges and rural B-roads would be no issue, but nevertheless this resolution would set a precedent for builders to delegate work to government contractors without fair compensation. Imagine if such a resolution were to pass in the real world - our taxes would skyrocket because you, the people, would get the burden of compensating all this "free labor."
  • And without fair compensation, the laws of economics dictate lower quality work. This resolution also states that free projects would not have to be approved by vote, while paid projects are still subject to popular approval. Imagine a desperate builder or city planner wishing to get a project completed. If time matters to them more than money, this would incentivize them to make their project free. The result is a decrease in economic mobility. From my last point, there is no economic incentive for "free" projects to be of the same high quality as a paid build; so not only would our economy be less mobile, but our quality of infrastructure would decrease as well. For a server all about infrastructure at its highest and most innovative quality, this point worries me greatly.
  • The "fast-track for free" and "executive's wallet bypass" provisions in this resolution would turn our current system of checks and balances on its head. Should the President choose to fund a project with their own money, according to the text of the resolution, no General Assembly approval would be required. This is an easy way for one man to override the will of the people. I am not an Admod, so I cannot speak on their behalf necessarily, but when debating an idea for a road, their opinions may be different from ours. If we desire to have a pure democracy which looks out for smaller cities (as many of you claim to seek,) what's wrong with gaining two seals of approval - from both the Admods and our peers - to respect the rights and thoughts of those smaller cities?

I rest my case. Perhaps you think differently than I do on this resolution - heck, perhaps I may have read something wrong and jumped to conclusions. But I'd like to hear your thoughts on the economic and democratic consequences - whether positive or negative - that this resolution would entail should it pass.

Presidential Response

  • 1. We have never paid anyone to complete a project. People volunteer to do projects. The UC does not have the authority to force someone to complete a project without pay. This is not the real world, and therefore, there are certain economic principles that cannot be applied. Well I appreciate your sentiment for realism, the server does not have a system set up to allow for organizations to run their own finances. This would require accounts that could be controlled by an organization rather than a player.
  • 2. Very little construction on the MRT is paid. The entire MRT system, for example, was constructed by the staff without pay. I renovate Central Park every month along with MinecraftYoshi26, and we are not paid for that. The staff does not pay players to construct roads. Really the only instances where people are paid to make infrastructure are airports, and that's usually me building them. Just because people are not monetarily compensated does not mean they will do lower quality work, as is evident on the majority of the MRT's infrastructure.
  • 3. The point of this legislation is to allow projects to be completed in a timely fashion without placing a financial burden on the general populace of the UC. It does not make sense that a committee should need approval to complete a project that does not affect majority of the UC. The purpose of the committee system is to bring people with similar skill sets together to work on projects. If a committee, for example, is building a road that passes through a relatively small section of the server, it should not need the approval of the entire UC. Instead, it should need only the approval of the towns through which the road passes, which is already required under the server rules.

All in all, the current system prevents projects from moving forward and requires executive committees to be forced to jump through unnecessary hoops that legislative committees easily bypass. The law protests the members of the UC from financial burdens to which they do not agree, whilst still allowing projects to be completed in the most efficient manner possible.

Resolution 64: The Bill of Rights

This resolution is a constitutional amendment.

The following rights are granted to all members of the United Cities by this amendment:

1) All members of the United Cities are granted the right to freely express their opinions and ideas.

2) All members of the United Cities are granted the right to leave the organization at any time and rejoin without penalty.

3) All players who meet the eligibility requirements to become a member of the United Cities have a right to do so at any time.

4) No member, who meets the membership eligibility requirements, shall be removed from the United Cities, or have their membership status reduced to observer, without their consent, except by constitutional amendment.

5) All members of the United Cities are granted the right to engage in political activities related to the United Cities, including campaigning and the proposal of resolutions, without restriction.

6) All members of the United Cities are granted the right, in elections, resolutions, and any other case whatsoever, to vote for any candidate or choice presented to them, without penalty.

7) All members of the United Cities, who meet the eligibility requirements for any officer position up for vote at any election, are granted the right to register as a candidate for that position, without obstruction or penalty, provided they register before the constitutional registration deadline for the election in question.

8) The United Cities shall take no action, executive or legislative, to restrict any of the aforementioned rights granted to the members of the United Cities. Any enacted resolution or portion of an enacted resolution in conflict with this amendment is hereby unconstitutional.

9) The previous section of this amendment shall not be construed to deny the General Assembly the power to amend this amendment through the passage of additional constitutional amendments.

President's Official Statement

First of all, I would like to thank everyone for actually voting in this resolution. It would be nice if we could see this kind of turnout in future resolutions ;).

Now, I must address the concerns that many of you have echoed to me concerning this resolution. One of the main complaints that I received was that this would be the death null for political parties in the UC. I simply fail to see how this is the case. This resolution simply allows multiple UC Members of a political party to run for the same office concurrently. If anything, this makes parties more enticing. Without this resolution, members of a party might choose to simply leave if they do not win their party's primary.

This, I must also point out, does not prevent a party from releasing an official nomination for the candidate of their choosing. Any party can still hold a primary and nominate a specific candidate. This, furthermore, encourages a party to unify after a primary in order to satisfy those in the party who may have dissenting opinions.

Basically, what I am saying is political parties, as they always have, may continue to play as much of, or as little of a role as they wish to play. Parties have been and will continue to be a place for those with a common ideology to stand together and work towards a shared set of goals. This resolution does nothing to change that.

I know that many people will not agree with this (probably at least 11 of you), so I encourage you to send me a message in Discord if you have any further questions. It's possible that I missed something entirely, but I probably won't be able to see it unless someone points it out to me. What I know is that given the information that I have at the moment, I feel that the best course of action for the overall well being of the United Cities is to pass this resolution.

Resolution 66: April 2017 Election Act

This resolution is a constitutional amendment.

Upon the passage of this resolution, the deadline for applying for an officer role will be set as Midnight GMT on April 8th 2017.

The debates for the April 2017 United Cities election will be held on the date with the most available attendees in the results of the United Cities Election Times Poll. The debate will start at 7 PM GMT on Saturday, April 15th 2017.

The host of the debates will be chosen by the president and approved through resolution. The host must not already be part of the United Cities. The location of the debates will be chosen by host without approval through resolution.

If a candidate does not attend the debate, the United Cities is not responsible for their absence, however they may notify of their absense and appoint another player to speak on their behalf.

The Election Clerk will be chosen by the President through powers of Amendment 13.

Voting will open at 9 PM GMT on Sunday, April 16th 2017.

Voting will last for exactly seven days, and if there are any delays in the opening of voting, the time limit for the closing of voting must be adjusted. In the event the voting form is not closed by the deadline for the conclusion of voting, any votes submitted until the closing of the vote will continue to be accepted.

To VernCow, and others who will vote other than the suggested terms: just because the United Cities court has ruled it allowed to vote in that way, it doesn't mean you should. Resolution 68: The Law Act

Proposed by KittyCat11231 with a Presidential exemption from _Kastle.

This resolution is a constitutional amendment.

This resolution creates a new officer position of the United Cities, to be known as the Attorney General. The Attorney General of the United Cities shall be responsible for manners related to United Cities law, including maintenance and updating of the Constitution, the Enacted Resolutions list, and the Resolutions Archive, for acting as a legal advisor to the President, and for representing the United Cities in the United Cities Court.

Under this resolution, a new cabinet-level department, the Department of Law, shall be created, led by the Attorney General. The Department of Law will include the Attorney General and any staff members the Attorney General may appoint to assist in his or her duties. For the purposes of definition, a cabinet-level department is considered to be a department led by an elected officer, which include the Department of Law and the Department of State.

The Attorney General will be subject to the same conditions as the majority of other officer positions of the United Cities with regards to eligibility and term limits. The Attorney General will be elected alongside other officers at United Cities elections. The first Attorney General will be elected at the April 2017 Election. Between the passage of this resolution and the announcement of the results of the April 2017 Election, the President may appoint an Acting Attorney General, who may be themself, to lead the Department of Law.

In the event an Attorney General leaves office and it is more than 15 days from a United Cities election, the President will nominate a successor, who will be confirmed in the same manner as described in Amendment 20 for other officers. In the event an Attorney General leaves office and it is within 15 days of a United Cities election, the President may appoint an Acting Attorney General, who may be themself, to lead the Department of Law until a new Attorney General is elected.

This resolution amends Amendment 20, placing the Attorney General behind the Secretary of State and ahead of the Chief Justice in the line of succession for the Presidency.

Resolution 67: the Introduction of Voting Guidelines Act

This resolution is a constitutional amendment.

In response to the ruling of the United Cities Court, under Case #4, the following has been proposed as official voting guidelines:

  • Do not add conditions to your voting. This is simple yes/no voting, don't add anything extra.
  • If you want to abstain or are neutral, don't write that, just don't vote.

These guidelines will exist alongside the remaining two unofficial guidelines.
Failure to comply with these guidelines will result in the delegate's vote being declared null and void.

1What I find funny is that while Kitty chose not to vote for or against the resolution, Kitty was the first one to say get rid of the committee even though he refused to participate. He was pinged when the survey was released and private messaged. But he continued to ignore and help hinder the progress of this committee by refusing to participate. However he made sure he knew how to announce to everyone he was going to disband the committee. Which seems very hypocritical. You say that the committee has achieved nothing yet you have not in any way shape or form tried to help the committee get anywhere. So what is the point in voting yes. He probably only wants to pass it so he can boast in the eletion that he has proposed and passed a number of resolutions / amendments. This resolution will specify the process for removing an officer. An impeachment resolution shall be defined as a resolution which if passed removes a person from their office in the United Cities. They shall be the only way to remove an officer - normal enacted resolutions may not remove an officer from their position. Officers that are removed from an office in addition to removal are also disqualified from holding an office or acting in place of an officer in the United Cities until the General Assembly by a simple majority returns this qualification to them through a normal resolution, which may or may not be vetoed by the President. Impeachment resolutions, like other resolutions, must get 3 endorsements in order to be put on the floor of the General Assembly. However, unlike other resolutions, impeachment resolutions must have had at least 15 people vote on it before voting closes. If, after 24 hours, at least 15 people have not voted, voting will remain open until a 15th person casts a vote. Impeachment resolutions also require 60% of all the votes cast to be in favor to pass instead of a simple majority of the votes cast. Impeachment resolutions may not be vetoed by the President and come into effect immediately following passage of the General Assembly. Finally, it shall be established that the power to impeach and remove an officer from their position shall be with the General Assembly and only the General Assembly and that the neither the Court nor any other body in the United Cities shall have the power to remove an officer.

Resolution 77 - The Election Tiebreaker Act

This resolution is a constitutional amendment.

This resolution defines what is to happen should any election for an office of the United Cities end in a tie. For the purposes of this resolution, a tie is defined as a scenario in which the election ends with the top two candidates each receiving exactly 50% of the vote, after all other candidates have been eliminated and their votes redistributed in the instant-runoff voting system detailed in Amendment 17. Should an election for any office of the United Cities end in a tie, the Election Clerk must declare a tie upon the release of the election results, and the position for which the election is tied is to be declared vacant. The incumbent officer for such position will be designated the acting officer for that position, except for the position of the Presidency, until the vacancy is filled, and a modification of the procedure prescribed in Amendment 20 will be used to designate the officer for that position. If the vacant office in this situation is that of the President, the newly elected Vice President will become Acting President. The Acting President must then, within 48 hours, nominate one of the two candidates who tied in the Presidential election to become President, who must be confirmed by resolution as detailed in Amendment 20. If the vacant office in this situation is that of the Vice President, Secretary of State, or Chief Justice, the incumbent for the position is to be designated the acting officer for the position until the vacancy is filled, and the newly elected President is to nominate one of the two candidates who tied in the election for that position, who must be confirmed by resolution as detailed in Amendment 20.

Resolution 82: The Executive Act

Proposed by KittyCat11231. Endorsed by hvt2011, _InDev_, and jphgolf4321.

This resolution is a constitutional amendment.

This resolution creates an official wiki page of the United Cities containing Executive Actions of the President of the United Cities. Executive Actions are defined to include any action the President has the authority to take without the approval of a resolution. This includes the creation and disbandment of Executive Committees, nominations of officials, and other orders, which, if within the authority granted to the President, are legally valid. No Executive Action may conflict with the Constitution or any Enacted Resolution, nor may it seek to create law, rather it shall serve to execute existing law as authorized by the General Assembly. The record for Executive Actions will include the President who issued such action, any additional authorization needed to issue such action (such as the approval of two officers to create Executive Committees), and the full text of the order. The page is to be the responsibility of the Department of Law. Following the passage of this resolution, the Attorney General is to codify previous uncodified Executive Actions.

Discussion

   CaptainChimpy votes that the proposal should be rejected. I'm voting to reject this resolution. I don't see a reason to have to. The Housing and Urban Development (HUD) committee hasn't done much, but what could it do? Where is the potential for it to flourish? There is so much we could do to grow the HUD. Remember all, this is a city building server.
Some may argue that the roles of the HUD is already taken care of by other committees, such as the Parks and Recreation committee. However, the PaR committee's power only extends to parks and recreation. The Parks and Recreation committee does not have the power to advise on roads and transport infrastructure. The Transit committee doesn't have the power to advise on intracity projects; it can only build and manage intercity transport schemes. The Roads committee doesn't have the power to advise on roads within cities, only on roads between cities.
So what could this committee do to develop and grow? I am not a member of the committee, but I am putting forward a few ideas for the committee members to consider.
Explicitly, this committee takes care of Housing. There is so much it can do. Maybe create a scheme that looks at the housing options available in cities. Are there a range of housing options available to residents? How is housing integrated into the overall profile of the city? What could a city do to accelerate housing development aside from building tall, swanky towers? Does the city feel alive? What could the city do to bridge the residential-retail divide?
The committee would also do well to co-operate with the Parks and Recreation committee. As a member, I would personally welcome working together with the HUD. Committees can flourish. We just don't have the skills, or even the incentive to do it.
Committee members, please look at yourselves and ask: how could this committee improve?
Again, this is a city-building server. Part of the United Cities' Prime Directive is to build "a stronger MRT community through large, cooperative projects". If we keep the HUD committee, we are signalling an intent to improve and build upon the strong base of the MRT.
Remember: If the UC wins, we all win.


 !  Comment from jphgolf4321: I voted to pass this resolution because the Department of Housing and Urban Development has done nothing for most of its existence and shows no signs of doing anything in the near future. If people really want HUD to remain and do its job, they should back their arguments for keeping it up with action in the committee. If its job would be better done split up in other committees, propose a resolution expanding those other committees' jobs and jurisdictions. HUD is unnecessary in its current form, and its job would be done more efficiently if other committees which have actually done things were allowed to do it.
 !  Comment from CaptainChimpy: And that's why I'm voting to keep the HUD. In that way we can reform the committee in order to increase its efficiency. As I said before, the Parks and Recreation are only able to advise on green spaces. The HUD has so much potential which we haven't tapped into. If we just voted to pass this resolution, we wouldn't be resolving the problem. We'd be delaying it. Like I said: the committee shouldn't just blindly vote to dissolve itself.

This committee will create a sub page under the United Cities wikipage that shall consist of advice regarding building techniques and city development to help attain higher ranks." The Committee Server its purpose and it has only done a building guide. There is no need to do anything else as advise to players is done when a player asks another player for feedback (an easily done thing) and I feel as it makes the committees purpose redundant and excessive.

jphgolf4321 wants to build a new housing estate, but he doesn't really know how to do it. This is where the HUD would be able to operate. It could suggest where relevant transit infrastructure should be located (currently, city-level transit is not under the jurisdiction of the Transit committee). The Roads committee could suggest ways of linking up said housing estate to the greater MRT. And finally, the Parks and Recreation committee could suggest ways of integrating greenery and beauty into the estate. The HUD could take all of this into account and advise jph on how to build his estate. This is a prime example of where all four committees can flourish and co-operate. But this can only be possible with the rejection of Resolution 83, and the subsequent reformation of the HUD.


 +  mjpwwf votes in favor of the proposal or nomination. I agree with JP on his above points. HUD hasn't been productive recently, and it seems there is no reason to support the renewal of the committee lest the UC become bloated with bureaucracy, forgetting what it was really meant to accomplish. Should HUD become active again, there are a number of ways JP mentioned in which its duties could be renewed and updated. However, that is not the reason why I comment on my vote. Rather, I propose a Third Way.

Chimpy is correct when he cites the Prime Directive of the United Cities: cooperation to build large-scale projects and assist others in planning and constructing their dreams. The Building Guide will be kept. We do not - I repeat, NOT - desire to leave new members who need tips and advice in the dark. (Besides, such partisan rhetoric will divide us further and do less to support those newer members.) Instead of keeping an inactive committee "funded," thereby wasting resources which could be used beneficially elsewhere, what's wrong with opening up the Building Guide as a page which anyone can add tips to? This would ensure cooperation on a larger scale which would address not just housing design (as Chimpy stated) but also terraforming, commercial structures, and transportation. Perhaps the best advantage of such a proposal is you don't need a government committee to keep the collaborative spirit running.

 +  mine_man_ votes in favor of the proposal or nomination. I agree with what mjpwwf said. I was never for this committee and the only reason i did little towards it was because i believed intruding on how people make towns would upset and anger people. It is not the UC's responsibility to manage towns in this way.

If we did not find a city appealing or attractive etc, then of course we would want to criticise them. I have seen you do that a number of times, and thus you are being hypocritical in the fact that you say you don't want to intrude on how people make towns as it could make them upset, yet you comply to a system which does exactly that.

I plan to propose a resolution doing exactly that, and whatever the fate of this resolution, I invite you to join me.

Resolution 84: The Debate Act

This resolution is a constitutional amendment. This resolution amends Article 4: Resolutions by adding the following: The secretary of state has the authority to define when a debate has started on a resolution and can call a 24 hour extension to a resolution. As a check the president can override this extension. This allows members from all timezones to contribute effectively to debate, as this debate affects the outcome of a resolution. This resolution applies to every resolution after its passage.

 +  CaptainChimpy votes in favor of the proposal or nomination. I'm supporting this resolution. I feel that the UC is starting to fall under the control of a few people. On most resolutions, the average voting numbers are 6-10 people. This resolution will encourage people to vote, especially from Asia and Australia. According to the Prime Directive, the UC should be "fostering good relations among towns and cities across the server". Too few people are voting, and this resolution will help to promote inclusivity of the collective. Simply put: Resolution 84 is designed to benefit the many, not the few.

   Ptld votes that the proposal should be rejected. May I add that people vote more on closer resolutions ardy, resolutions where there vote is needed most. Res 82 had less votes as it consisted of a straightforeward point and was unanimous. People want to vote where their vote is counted. Not when their is discussion.
 !  Comment from CaptainChimpy: The resolution only supports extending the time limit to 48hrs should there be considerable debate going on and the Secretary of State has agreed to extend it. Therefore, simple, straightforward resolution such as Resolution 82, which you have indeed pointed out, would not be affected by this clause. Resolution 84 will increase the voting time only when there is a sufficient amount of debate AND the SoS has agreed to it. Thus, your point stands invalidated.

   jphgolf4321 votes that the proposal should be rejected. Had I had the chance to vote before it was relaunched I would have, but I will still vote nay on this because the Secretary of State clause makes no effort to define debate and leaves it up to the Secretary of State to do so. If a Secretary of State were politically motivated to extend a resolution, the SoS could define "Apple pie is my favorite" as a debate and extend the voting in what essentially amounts to a modern American filibuster. Inversely, a SoS could for political reasons refuse to recognize a legitimate debate as such and keep a resolution to 24-hour voting in an effort to disenfranchise less-active members.
I will concede that you make a good point about debates increasing voter turnout in resolutions, but 24 hours is plenty of time for a fully-fledged debate to take place as is going on with the present resolution and Resolution 83. Extending voting another full day would only bog down the system and potentially cause a backlog of resolutions.

Vetoed. This resolution gives the secretary of state broad powers to extend a resolution's voting for more or less any reason. Furthermore, the notion that this somehow helps people in different time zones is ridiculous. Whether you are in Germany, Hong-Kong, or the US, there are still 24 hours in a day. Should Resolution 83 be enacted, this resolution shall remain inoperative.

 !  Comment from MinecraftYoshi26: Yes, as the votes can be taken out of proportion, and can make it more difficult for people who count votes. Additionally, yes, you can ask them, but if multiple people do do it, asking them every single time is a nuisance. If this passes, the issue won't matter, and there won't be any more problems regarding this. Furthermore, this keeps the page uniform and organized.

 +  MinecraftYoshi26 votes in favor of the proposal or nomination. The reason I'm putting this out is because it organizes and uniforms votes. If you're wondering why I voted weirdly and absurdly in the past resolutions, it was to show how annoying it can be, how extreme the law can be taken, and why it needs to be brought up. Should this resolution fails, votes will continue to be differing and difficulty counting votes and non-uniformity will continue to happen and this petty debate will continue. However, if this resolution passes, this issue will most likely cease to exist and make the voting system more uniform and established.

To be honest, when the UC first started, it was a REQUIREMENT that people voted only using "NAY" or "YEA" and all other votes not using these 2 words will either be discarded or asked to change back to NAY or YEA. However, after a while things changed and people were allowed to use other words instead of NAY and YEA. In fact, the court even passed a complaint and concluded saying that other words are allowed, so there isn't really a reason to change it back, nor should the UC limit what words we are allowed to use. If this resolution passes I'm still going to continue using other words depending on my mood. BTW, 아니 means no.

It was never a hard requirement to use those words, it just turned into a custom that was eventually broken when Case #4 was called, which had no legal standing and was an obvious attempt to invalidate a resolution for political gain. Secondly, and I will only say this once, but If you put your response in a foreign language, I would highly recommend that you write it in English because it may be invalidated. Resolution 88: The Resolution Amendment Bill

Proposed by Cal76 as the result of a Chief Justice case. Endorsed by KittyCat11231, hvt2011, and MinecraftYoshi26

This resolution is a constitutional amendment.

In any such case where the author of a resolution, currently in the voting process, they must show the edited text to either their cosponsors, or any other member of the UC in the case where they may choose to use a different cosponsor (or the President in the case of an exemption). All the cosponsors (or President) must give their blessing for the resolution to be edited.

Furthermore, an edited resolution must have both the voting time and any votes reset, as if it was a brand new resolution. An announcement that the Resolution has been changed will then need to be announced somewhere in the UC Discord, using the @everyone tag.

Edits do not include simple spelling or grammar mistakes.

Resolution 90: The Court Amendment Act

This resolution is a constitutional amendment.

This resolution authorizes that, upon the filing of a complaint with the United Cities Court, a justice of the court may issue a preliminary injunction, acting as a temporary binding court order, until the case is fully reviewed by the court. A preliminary injunction shall expire after 24 hours, or upon the delivery of the final verdict in the case, whichever should come first. Should a verdict not be delivered within 24 hours of the preliminary injunction being issued, it may only be extended with unanimous approval of the justices of the United Cities Court.

Discussion

   mjpwwf votes to oppose the proposal or nomination. While it's tempting to vote for this resolution for the sake of productivity and efficiency, I prioritize the preservation of our democratic nature and its protection for all voices, including those of dissenting opinions, before any ideological legislative warfare disguised as "efficiency." The power of the presidential veto is necessary; we elect some leader wise enough to see the flaws in an otherwise "perfect" resolution, and in doing so we are forced to go back to the drawing board and compromise - not give in and sell out our party and the promises we make to the people who elect us, but compromise.

Over the life of the United Cities, there are a growing number of members who seem to be more interested in pushing an agenda and creating their dream utopia over working together to produce solutions which will work for everyone, not just those of the majority. Not everyone believes their solutions are right - and with checks and balances such as the presidential veto, they know they will have roadblocks. They're politicians - naturally, they want the easy way out of their issues. Instead of doing hard things and working together, they choose to work alone and find the best loophole they can use. If checks and balances threaten to stop them, then they will seek to remove those checks and balances. It's human nature, and is one of the reasons why we do need safeguards like minority opinions and the presidential veto.

I believe this resolution would silence both of those crucial safeguards, and adds to the bigger problem of the tyranny of the majority. I have many times warned (albeit to no avail) of the disaster the tyranny of the ideological majority would create. MRT members have lives, and if the president isn't constantly on the MRT to vote on everything that comes their way, I believe our democratic principles will succumb to the tyranny of the ideological majority.

It doesn't have to be that way. Our first step is to kill this resolution, and any resolution that tries to even touch our already-strong check and balance system. We can then move on to the most important step: becoming pragmatists, working together, not one-sidedly and independent of each other like ideologues, to produce solutions to issues that directly affect us as citizens of this server. I believe everyone, whether the President or a new GA member, has an important voice that must be heard. Any attempt to monopolize the kind of voice we hear will only destroy what makes us great.
 !  Comment from CaptainChimpy: On your last point: While you do say we have to work together, to make the UC a better place for everyone, it should be noted that in fact this is the first example of legislative bipartisanship. We know that there are two groups - the GSC and the MRTI. For the first time in recent memory, both sides agree on one thing. This resolution isn't the product of just one side, one idea, one philosophy. It's the result of two working together.

   Ptld votes to oppose the proposal or nomination. While I support the intent of this Resolution I also agree with mjpwwf's points. This resolution is needed for times sake but the length of the timeframe isnt fair to the President. We all have lives and I know that over half of the members in the UC are in either Elementary, Middle or High School and even College. This resolution forces presidents to allways be attentive to when a resolution passes. However, I support the idea of having a new resolution proposed if this one fails or passes that lengthens the timeframe to 48 Hours allowing 2 Days for a Resolution to be passes by the President. This Resolution is needed but we have to remember. This is only a game and not real life. We all have a life we need to live outside of the MRT. Even the President. Even You..

Though most committees and small, with 5 members, the Parks Committee is at 7 members and is getting real large, so this resolution mainly prevents committees from getting too large and become a little too powerful.

   Ardyle votes to oppose the proposal or nomination. Limiting the minimum to 3 is a very good move as it cuts off all the unnecessary executive action the president might do through proxy committees, but the maximum limit doesn't seem to have any point. When a larger committee ends up being unmanageable, it's the leader to blame for not being able to get the members to cooperate, not an arbitrary number that equates to the amount of people who serve as the members of the committee. If the first part was proposed seperately, I would be voting yes on that.

   CaptainChimpy votes to oppose the proposal or nomination. Here we have a committee. Should this resolution pass, said committee would be limited to between 3-7 members. Large committees, such as the Parks and Recreation committee, need a lot of leeway to be able to operate. Such a committee would instead have multiple aims (in fact there are 4 core aims listed on the wiki page). 7 wouldn't do for 4. Instead, the committee's effectiveness and work would be massively slowed down. I concede that there needs to be a lower limit to prevent committees being the president's proxy, but committees should be allowed more flexibility to be able to manage their workload with a sufficient amount of people. Should a large committee be unmanageable, it's the leader who should take the blame as they obviously show no team-building skills..

 +  mjpwwf votes in favor of the proposal or nomination.This was a tricky decision, given the various good points which have been raised on both sides of the argument. I do very much agree with the 3-person minimum, and will support that clause no matter what happens. With regard to the maximum limit, I believe committees should have the leeway they need to run efficiently and carry out their task. Otherwise, we're wasting our time. That said, to prevent a large committee from turning into a machine and gaining too much extra-constitutional power, I keep a single principle in mind. You could call it Pueff's Law: A committee should only have whatever resources it requires to operate efficiently; nothing less, and absolutely nothing more.
Better standardization of committee numbers would more effectively promote two things. The first is organization of the various committees making up the United Cities, meaning more productivity overall. If every committee has access to the same number of resources as every other committee, no one committee will overpower the other, and every committee will be equally productive. Any skew of the balance will stop us from addressing all the issues in our platform equally and giving equal right to all concerns we hear. Efficiency? Nope.
The second issue this resolution would solve ties in to the first somewhat: equal participatory opportunity. As the UC faces more, increasingly complicated issues, we need to operate at maximum efficiency. The best way we can do that is to take advantage of our large numbers and allow every new member of the UC the opportunity to have their voice heard in a committee. There are a number of ways we could approach this issue further; perhaps one way is to assign members not serving as officials to a committee upon joining the UC, then continually rotate which committees members serve on with election terms. However we approach the issue, guaranteeing the opportunity to join a committee would help members get further involved and allow us to hear as many viewpoints as we can.

The General Assembly Meetings Act

This resolution is a constitutional amendment.

This resolution sets the procedure for General Assembly Meetings of the United Cities. General Assembly Meetings are defined as periodic organized meetings of the United Cities General Assembly for the purpose of debating policy proposals, receiving testimony regarding the activities of the United Cities from officials and committee members, and other related purposes. A General Assembly Meeting is to be authorized by a motion passed through resolution. The Vice President, as the chair of the General Assembly, may propose such a resolution without the endorsement of three other General Assembly members. The Vice President is responsible for organizing and facilitating the meeting, although the President reserves the right to assist the Vice President, or to assume the Vice President's role, or assign it to another player, should the Vice President be unavailable. The time and date of the meeting must be specified in the authorizing resolution for it to be valid. The Vice President has the discretion to delay the meeting in events including the absence of members, but if the meeting is delayed longer than a period of two hours the meeting is considered cancelled, and a new resolution must be passed to hold a meeting if desired.

The Vice President is responsible for directing the agenda of the meeting. Any General Assembly member present at the meeting may propose a policy proposal for the Vice President to add to the agenda. Proposals are to be debated on and presented for comment of General Assembly members. The purpose of this debate is to make appropriate amendments to the proposal and encourage the sponsor of the resolution to incorporate suggestions by other General Assembly members. However, the resolutions proposal process will still remain as is, and General Assembly Meetings may not be used to pass resolutions.

This resolution amends Article 1.2.1 to define the General Assembly as consisting of all non-Observer members of the United Cities, excluding the President.

Resolution 93: The Improvement of the Pocket Veto Act

This resolution is a constitutional amendment.

This resolution shall establish deadlines on the action a President takes on legislation. Once a resolution passes the General Assembly, the President has 72 hours to either sign or veto the resolution. If the President does neither within 72 hours, it shall be assumed that the President does not approve the resolution and it shall be sent back to the General Assembly as a "pocket veto." Pocket vetoes, like normal vetoes, may be overridden, however they only require 60% of all the votes cast to be in favor for an override, as opposed to 75% for an override of a normal veto. Finally, if a President "pocket vetoes" 3 consecutive resolutions that have passed the General Assembly, then the President shall be marked inactive and his powers shall be stripped and given to the Vice President to become Acting President as if the President has been away for 15 days.

The United Cities shall no longer be required to run a debate between all candidates in order for an election to proceed. This shall not be construed to ban the sponsorship of debates by the United Cities or any non-United Cities organizations.

The position of Election Clerk shall hereby be abolished. Instead, the President shall appoint a five-member committee, the Election Oversight Committee (EOC). The EOC shall not have any restrictions other than the members of the EOC must be members of the MRT server and that they shall neither be the incumbent President nor be running for a position in the current election. Both members and non-members are allowed in the EOC, regardless of political affiliation, however if a person who is not a member of the United Cities is appointed to the EOC, he/she must be allowed access to the United Cities Discord for the duration of the election. Members of the EOC are not immediately required to be confirmed, however a petition with 8 signatures may be submitted to the Attorney General in order to require that a member of the EOC be confirmed by the General Assembly; if the person fails confirmation, the President must nominate a successor who again does not require confirmation unless another petition is submitted against him/her.

The EOC shall assume all the responsibilities of the Election Clerk. The EOC shall create and monitor the forms used for voting in elections and they shall make sure that voting irregularities shall not occur. They also shall count up the votes. The ID system used in previous elections shall, however, be abolished, and players shall be required to give the username in ballots. The EOC shall decide how to combat voter fraud. The EOC shall also have their own Discord channel, which shall be public to allow public oversight of their activities.

Finally, the United Cities Court shall be given the power to audit the elections. There shall be a 48-hour “grace period” after an election’s results are released in which the Court may start an audit; if the grace period concludes without an audit beginning, the new officers shall take office at the end of the grace period. If an audit occurs, the Court must release a justification of the audit on the wiki. Audits shall consist of the Court doing interviews of voters and looking at the forms. During an audit, the election results are put on hold and the newly elected officers shall not take their office until the audit is completed. Audits must conclude within one week of the election results being released. If the audit reveals that the election was tainted (i.e., rigged), all records of the election are publicized for all to see as are all records of the investigation, including interview transcripts, and the Court must order that an election occur within one week. The previous, tainted election shall be voided; legally it shall not have happened and will not count towards term limits. For the new election, a completely new EOC must be appointed, and all of the members of the previous EOC are forever banned from being appointed to the EOC again.

Resolution dies.

 N  mjpwwf votes neutrally on the proposal or nomination. I oppose this resolution as it stands now. It is a good start, but I see certain red flags within the resolution that discourage me from fully supporting. There are ways it could be tweaked to earn my YEA vote, which I will elaborate on below..

Firstly, require all EOC nominees to be confirmed by the General Assembly. Mr. Zomperman, in explaining the reasoning for his resolution (through his own news network,) cites the open criticism of the code system; namely, that it could allow the President to fix an election through passing out fake codes. This point is correct. Rigged elections are dangerously undemocratic things, and Yoshi's done a fine and ethical job handling the large responsibility of overseeing the peaceful transfer of power - so fine that the General Assembly has confirmed him twice. Why do I make this point? This resolution would give the President power to appoint five election clerks, which isn't a problem in itself. The problem is that unlike the old system, the appointees are unchecked, and the petition process to require an appointee be confirmed by the General Assembly is not an easy one if members don't have the right social connections or friends-of-friends. If we want to keep elections fair (as Mr. Zomperman and I so wish,) then control of the elections has to be out of the executives' hands, and the consent of the governed must take a central role.

Secondly, protect the secret ballot by replacing the codes - with something other than usernames. Forty-four US states have a provision in their constitutions which guarantees that the vote and the identity of the voter remain disassociated. (The other six at least have statutory provisions that reference the secret ballot.) All this protection of voter secrecy is fundamental for election integrity and several rights protected in even the UC Constitution; namely, the rights of free expression, uninhibited political activity, and especially the right of members to vote for the candidate they choose without penalty. (See Amendment 27.) Shortly after the UC's inception, we didn't have the secret ballot (See Amendment 13b, text struck by Amendment 14.) By requiring codes to be submitted instead of usernames, dissenting voices at least have some protection, and are better able to vote for the candidate they choose with confidence, not fear of what people will think. Today we see a climate of identity politics, political correctness, "social desirability bias," fearmongering, and division, where many voters across the globe risk demonization and ridicule for simply disagreeing with the loudest, typically most elite voice. As a democratic system, our duty is to protect all voices - including those dissenters. By requiring users submit their username with their ballot, that layer of protection is removed, and we risk contributing to that freezing-cold climate.

How do we get ourselves out of this snafu, then? I'm not saying the code system is perfect. It's not. There are other ways we could ensure voter integrity, the most elementary being one-IP-per-submission or one-account-per-submission. We could go a step further and incorporate passphrases with names, similar to another popular voting system on the MRT, then make those phrases appear on one spreadsheet and the ballots they represent on another password-protected, read-only spreadsheet. I have a feeling we are thinking inside a box, and a little design thinking could go a long way when it comes to voter security.

Finally, incorporate some emergency clause in the event no active members are eligible to serve in the EOC through term limits. I'm in favor of hefty term limits for such an important committee to our structure. If we were the size of MinePlex, this would be no issue. We are above average in active member count for a server our size, but only slightly. With five members per election season, and one-term-per-life for them all, the chance does exist that we could exhaust the list of active members faster than new candidates become available. In case this happens, there must be some way of ensuring continuity of the committee.

Again, it's not that I vehemently oppose this resolution. Reforms are necessary, and this is a fine way to begin that debate. If these above concerns are addressed, I will likely change my vote.

I'd like to thank mjp and other members of the MRT for voicing their concerns about this resolution. It is very good that the democratic process of the United Cities works. Anyways, I'd like to address mjp's concerns as well as the concerns of others.
  • Yes, this seems like a good thing. However, I did not feel that it would be a good idea for five confirmation resolutions to be put out at one time. And the number 8 is the number I used for the signatures needed because most resolutions attract about 15-20 votes; 8 signatures at the very least ensures that the resolution is not useless and that the candidate actually has significant opposition. I do trust that future Presidents will not attempt to load the EOC with their friends, and urge that President Kastle and his successors make sure that the EOC is evenly divided between the two ideologies (MRTI and GSC).
  • I know that secret ballots are an essential part of democracy. However, it is even more essential that the ballots are safe, and it is much easier to rig an election that 40 people vote in than one in which 40 million people vote in. Submitting a username is likely the only perfect way to have a safe, transparent election. As for your proposals to compromise between both:
    • One-IP-per-submission: I'm assuming this would use SurveyMonkey. This would not actually preserve privacy. People on the MRT live so far out that the majority of members are the only people in their city who are from the MRT. For example, if I see an IP from San Francisco, California, I can deduce it's hvt because he's the only Minecartian from the Bay Area. If I see an IP from Portland, Maine, I can deduce that it's Ptld because he's the only Minecartian from Maine. Also, doing this would open the door for election fraud using proxies, which would allow ballot-stuffing. (Google Forms is preferred because it does not track IPs.)
    • One-account-per-submission: I assume this would use Google Forms, and specifically check off the requirement that you be logged into your Google account in order to submit a form. This both excludes people who don't have Google accounts and opens the door for ballot-stuffing by creating multiple Google accounts.
    • Passphrase with names: I think you're talking about the system where you submit a password you create with your username and PM the person who runs the form the password, but I don't completely understand what you are going for. I would like you to talk to me on the server and explain what exactly you are talking about - this may actually be workable.
  • There are no term limits. You are misinterpreting that clause. That clause actually says that if a Court audit shows a fixed election, that the members of the EOC who fixed the election are disqualified from serving on another EOC. If an EOC runs an election without failing a Court audit, then the members are eligible to be re-appointed for an election in the future.
As for Ben's claim - that the Election Clerk is completely fine - this is wrong. The Election Clerk system is susceptible to fixed elections, both because it allows the President to submit fake ID codes to the Election Clerk without anyone else knowing, and because it is opaque and there are no checks to make sure that the election is being run fairly.
And I feel some other people may feel that this is overcomplicated and vote against this for this reason. Yes it is complicated, but don't you want a fair election? Are you ready to sacrifice fairness and transparency for the sake of simplicity? Having checks on the election system is necessary.
In conclusion, Resolution 96 is justified, and if you have problems with it, still vote yes, and then after that propose another resolution with your suggested changes in it. Some progress is always better than no progress, so even if you feel 96 is imperfect, if you feel it's better than the current system, please still vote for it. Preamble to Resolution 99 and 100

Up until this point, the matter of the United Cities logo has been unlegislated, and has generally been assumed to be a matter for the President. However, a logo competition should be a bit of fun for people in the same sense as the MRT website screenshot competition. Good timing too with the 100th Resolution.

You may wonder why this has been split into two separate bills. The reason why is that some people may like the main United Cities logo to remain the same as it is, so the first bill will act as a confirmation of whether anyone would like the main logo to be changed or not. The second bill is for the creation of brand new logos for both the Court and the State department, which can if nothing else, add a little variety to the look of their wiki pages.


Resolution 99: The Betsy Ross Bill 1

A Competition will be launched to create a new logo, the winner of which becoming the new official logo of the United Cities. A Text channel shall be created in the United Cities Discord, named #Competitions, where any member of the United Cities may submit entries.

Upon the passing of this resolution the competition shall begin, and any potential competitors will have exactly two weeks to submit their logo design. They may submit as many designs as they like, but when posting an image it must be accompanied with the text “MAIN LOGO”, so to differentiate it from any other types of entries submitted in the competition channel.

Once the two weeks are up, the President will create a voting Form and organise all of the competition entries for the main logo into it. Members of the UC will then be able to rank each entry out of one to ten in this form. This voting process will last a week.

Once this week is up, the top two entries with the highest score in the form will then be entered into a new form, alongside the current UC logo, where UC members will be able to decide amongst the three, which one they prefer. This process will last a week.

The winner of the second form will henceforth from that moment become the official logo of the United Cities.
