The Preamble
We the people of the MRT, in order to establish a more perfect union, improve and expand infrastructure, and to encourage and foster cooperation between towns and cities throughout the New World, do establish and ordain this constitution of the Zeta Republic.
All governing power of the Zeta Republic shall be vested in a unicameral legislature to be called the Assembly of the Zeta Republic, or Zeta Assembly.
Section 1
Membership in the Zeta Assembly shall be open to anyone owning at least one town ranked Councillor or higher, with the respective mayor serving as the sole voting delegate. In the event a member owns more than one town, they must choose to represent either one town or a state representing multiple towns. Anyone not meeting this requirement, or choosing to be designated as such, is welcome to participate in the Zeta Assembly as an Observer. The President is not considered part of the Zeta Assembly and will lose their seat for the duration of their term. The process of joining the Zeta Republic consists of filling out all the proper fields in the membership table on its main wikipage. The process of leaving the Zeta Republic consists simply of removing said entries from the same wikipage.
Section 2
The Zeta Assembly shall have the power to amend the Constitution through amendment resolutions and pass enacted resolutions unrelated to the Constitution, where such resolutions must apply to the Zeta Republic as a whole or cannot be easily resolved by individual regions or members. All resolutions shall be restricted in their nature, with the following criteria to be enforced by the President:
- Resolutions shall not be binding for any city or entity.
- They shall aim to improve or otherwise positively impact the affected cities.
- They shall not restrict or expand the rights of any city within the Zeta Republic without doing the same to all members.
- Cities shall not be obligated to participate in any resolution affecting them outside the Zeta Republic without their express approval.
Section 3
All processes concerning the Zeta Republic as a whole shall be accomplished through a resolution system. Any member of the Zeta Assembly may propose a resolution. Each member shall receive one vote, with a simple majority required to pass an enacted resolution and a two-thirds majority required to pass an amendment resolution. The voting period shall end 48 hours after the resolution is put up for voting. If passed, the resolution shall take effect immediately. If it fails to pass, debate on the resolution is immediately closed. If voting on a resolution ties, the President shall have tie-breaking power.
A sole executive position shall be created and designated the Office of President, which shall be considered as both the Head of State and Head of Government
Section 1
The President shall be elected by a simple majority. Upon election, they shall formally take power at a formal swearing-in at the Capital, which shall occur within 72 hours after the end of the election. Their term shall last until 90 days after this event, unless impeached and removed. Discord server ownership shall also be transferred during this time period. Any member is eligible to run and be elected.
Section 2
The election of the President shall occur by means of Google Forms. The link to the Google Form shall be posted in the Discord server clearly visible to all members. Only members may vote. Individual voter codes must be submitted and confirmed in Discord or in-game for a ballot to be counted, of which only the most recent submission will count. The election shall be opened one week before the presumed end of the current term of the President, and shall be closed one week later. The current President shall be responsible for overseeing this process. The full results of the Google Form must be publicized by the President if an enacted resolution compels them to.
Section 3
The President shall be responsible for representing the Zeta Republic as a whole diplomatically and legally where such representation cannot be done easily by individual regions or members when associating with other parties. The President may, at their sole discretion, create a cabinet consisting of any number of members and roles to assist them in fulfilling their duties, and adjust or dissolve it at any time afterwards. The cabinet shall be dissolved at the end of each term.
Section 4
Any member may bring impeachment proceedings against the President, any cabinet member, or member of the Legislature or courts, through an enacted resolution. A two-thirds majority is required to impeach such an official, which shall result in their immediate removal from office. If said official is the President or a Justice, a special election is to be held one week later and will last for one week. If an election is currently in process, the special election will not be held. The office will remain empty during the interim period.
All judicial power shall be vested in an elected Superior Court. The elected Superior Court, fully the Superior Court of the Zeta Republic, shall have the sole power to decide cases in the nature of criminal law or civil law pertaining only to the Zeta Republic.
Section 1
There shall be three Justices, one of which shall be Chief Justice. Election intervals, term lengths, and the impeachment process for Justices shall follow that of the President’s. Justices will be elected concurrently with the President, with the Chief Justice being elected separately from the other two Justice positions. The Chief Justice shall be elected by a simple majority, and the two Justice candidates receiving the two highest votes shall be elected as Justices.
Section 2
In regard to the criminal law, the full Superior Court shall act as the jury, with the Chief Justice acting as judge, with the apportioned power of sentencing. In regard to the civil law, a single justice, rotated in alphabetical order, shall be enumerated the power to decide the outcome of such a case; with a possibility of trial by jury if requested by the accused and approved by the normally apportioned justice.
The MRT shall be divided into districts by the process detailed below. Only one level of districts will be created and officially recognized.
Section 1
A district may be created by the proposal of no less than two members of the Zeta Assembly, a majority vote in the Assembly, and unanimous consent of towns within the new district. District borders may be amended with the same process. A district may have no less than 3 towns or cities owned by no less than three individual members, and no more than 7.
Section 2
Special districts shall exist that are exempt from being part of any other district. Such districts consist solely of the Capital of the Zeta Republic and Central City.
Section 3
Districts shall carry out the main functions of the Zeta Republic, namely the development and connection of regions of the MRT. Each District will have its own discord category, where voting and general discussion may occur.
A capital city for the Zeta Republic shall be established, at the Zeta Republic’s earliest convenience, in the Zeta region and administered as a special city of the MRT, which shall, at a minimum, contain proper facilities for the aforementioned three branches of the national government.
This constitution shall be inoperative until ratified by unanimous consent by the interim legislature. Each individual shall receive one vote, including the President pro tempore.
The Bill of Rights
as drafted by Hon. EliteNeon of Shadowpoint and Northlend- Part I - The Government, be it Federal or Regional, shall make no law prohibiting the free exercise thereof, or abridging the freedom of speech; or of the press; or the right of the people peaceably to assemble, and to petition the government regarding grievances. The Government may not censor any statements made to the official record (Discord, Wiki) unless determined to be against supreme server rules.
- Part II - The individual cities and regions may choose to assemble their own military forces and civilian law enforcement branches. There shall be no interference in this practice by the government of the Republic. However, the Republic may request a military alliance during times of war and/or unrest, but it shall not be automatically ordered.
- Part III - The Government, be it Federal or Regional shall owe a person accused of breaking the law; and/or performing unconstitutional acts, and/or acts that do not reflect well when compared to the Republic as a whole; a fair and speedy trial before the elected superior court. If the accused shall request, the Legislature may leave decisions of justice to the Chief Justice of such a court.
- Part IV - If not explicitly mentioned in the Constitution, the Federal government shall retain the power to propose and/or enforce such a law regardless.
- Part V - The right to propose amendments to the Constitution is enumerated to all.
