Election Powers Act

1. Powers and Limitations of Parliament

  1. Only Parliament has the power to change the electoral process. This has to be done through a motion.
  2. Any Member of Parliament has the power to ask privately or not for a suspension of the ongoing Electoral Process to the Election Commissioner. In the case this happens, the member must provide solid reasoning to the Election Commissioner, and the latter has the power to refuse or accept the demand.


2. Powers, Duties and Limitations of the Election Commissioner

  1. The Election Commissioner has the power and the duty to count votes and keep them confidential.
  2. The Election Commissioner has the power to delay the electoral process by up to a week during the campaign phase. They must announce it in a public venue with full reasoning and this option may only be taken if there is an unexpected problem in the operation of the election.
  3. The Election Commissioner has the duty to announce the results of an election when the said election is over.
  4. The Election Commissioner has the duty to make sure that the election is being run as written in the Constitution
  5. The Election Commissioner has the duty to reject any non-valid vote, such as a vote coming from a non-member, and the duty to count every single valid vote.
  6. The Election Commissioner has the duty to oversee the elections.
  7. The Election Commissioner has the duty to tell the people concerned (such as MRT staff) if someone is violating an MRT rule during the Electoral Process.
  8. The Election Commissioner may not announce publicly who they will vote for. They may not influence the vote in any way and their announcements, communications or decisions must be as neutral as possible.
  9. In the case an Election Commissioner is unable to do their duties or violates the Constitution/the MRT rules, Parliament may decide to remove them from their functions via a motion of no confidence. The electoral process will continue during the process, if possible.


3. Power, Duties and Limitations of the Administration in place before the Election

  1. The Administration has the power and the duty to inform Members of how the election works, the status of the electoral process, but has to stay neutral in those announcements and communications even if they are running again.
  2. The Administration has the duty to make sure members and candidates are always respectful and respect MRT rules and the Constitution. They have to tell MRT staff if needed.
  3. The Administration may not interfere in any way in the electoral process in their official capacity.
  4. The Administration has the duty to give the powers and the ownership of the Discord Server without resistance to the winners if the Administration loses.


4. Power, Duties and Limitations of the Administration that won the Elections

  1. The New Administration has the right to receive the powers and the ownership of the Discord Server after the results are announced.
  2. The New Administration has the duty to manage with the best of their abilities the Federated States during their term.
